Terms of Service

Please read these terms carefully before using Vigilant.

These Terms of Service ("Terms") govern your use of the Vigilant Progressive Web Application and related services ("Service") provided by Vigilant ("we," "our," or "us"). By accessing or using the Service, you agree to be bound by these Terms.

⚠️ Important Notice

Vigilant is a safety coordination platform and is not a replacement for emergency services. In life-threatening emergencies, always call your local emergency number (10111 for SAPS in South Africa) in addition to using Vigilant features.

1. Acceptance of Terms

By creating an account or using the Service, you confirm that you:

  • Are at least 13 years of age (or have parental/guardian consent)
  • Have the legal capacity to enter into this agreement
  • Agree to comply with these Terms and our Privacy Policy

2. Description of Service

Vigilant provides:

  • Panic Alert System: One-tap emergency alerts with location sharing to linked responder organizations
  • Safety Timers: Automated check-in system that alerts responders if you don't respond
  • Sentry Mode: Motion-detection based security alerts
  • Incident Reporting: Structured submission of community safety reports
  • Community Map: Curated, verified incident information display

3. User Accounts

3.1 Account Registration

You must provide accurate, complete, and current information when creating an account. You are responsible for maintaining the confidentiality of your login credentials.

3.2 Account Security

You are responsible for all activities under your account. Notify us immediately of any unauthorized access or security breach.

3.3 One Account Per Person

Each user may only maintain one personal account. Creating multiple accounts may result in termination.

4. Acceptable Use

You agree NOT to:

  • Submit false panic alerts or reports
  • Use the Service to harass, threaten, or harm others
  • Share login credentials with others
  • Attempt to circumvent security measures
  • Use automated systems or bots to access the Service
  • Submit content that is illegal, defamatory, or infringes on others' rights
  • Interfere with the proper operation of the Service

5. Responder Relationships

5.1 Third-Party Responders

When you link to a responder organization (security company, neighborhood watch, etc.), you establish a direct relationship with that organization. Vigilant facilitates communication but does not control responder actions or response times.

5.2 No Guarantee of Response

While we strive to ensure reliable alert delivery, we cannot guarantee:

  • That alerts will be received by responders
  • Specific response times
  • The quality or nature of responder actions

6. Content and Intellectual Property

6.1 Your Content

You retain ownership of content you submit (photos, audio, text). By submitting content, you grant us a license to use, store, and share it as necessary to provide the Service.

6.2 Our Content

The Vigilant platform, including its design, code, and branding, is our intellectual property protected by copyright and trademark laws.

7. Fees and Payments

7.1 Free User Access

Basic Vigilant features are free for end-users. Premium features or integrations may require payment.

7.2 Responder Fees

Responder organizations pay per-user fees as outlined in their partnership agreements. These fees support platform operations.

8. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIGILANT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

We are not liable for:

  • Actions or inactions of responder organizations
  • Technical failures, network issues, or service interruptions
  • Inaccurate location data or device malfunctions
  • Decisions made based on community map information

9. Indemnification

You agree to indemnify and hold harmless Vigilant and its affiliates from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

10. Termination

10.1 By You

You may terminate your account at any time by contacting us or using account settings.

10.2 By Us

We may suspend or terminate your account for violation of these Terms, illegal activity, or at our discretion with reasonable notice.

11. Changes to Terms

We may modify these Terms at any time. Significant changes will be communicated via email or in-app notification. Continued use after changes constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Disputes shall be resolved in the courts of South Africa.

13. Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.
